Terms of service

How engagements work, what you own, and what we do and do not guarantee. Last revised 12 October 2026.

What these terms cover

These terms apply between you and Growth Sync whenever you engage us for work. They sit underneath whatever we agree in a specific proposal.

Where a signed proposal, statement of work or contract says something different from this page, that document wins. This page is the default, not an override.

Nothing on the rest of this website is an offer. Prices shown are starting points for scoping, not quotations.

How an engagement starts

You send a brief. We come back with a plan, a price and a start date, normally within four working days. Work begins when you accept that in writing and the first invoice is settled.

Scope is written down before anything starts. Anything outside it is a change, and a change is priced and agreed before we build it rather than invoiced as a surprise afterwards.

Fees and payment

All prices are quoted and invoiced in US dollars unless a proposal says otherwise. You are responsible for any bank charges, currency conversion costs, withholding taxes or local sales taxes that apply where you are.

Project work is billed against fixed-price milestones, typically a third to begin. Retainers are billed monthly in advance.

Advertising budget is separate from our fee and is paid by you directly to the platform. We do not mark up media spend, and we work inside your own ad accounts.

Invoices are due within 14 days. Work may pause on overdue invoices, and we will tell you before it does rather than quietly stop.

The 14-day refund

If we are not the right fit, tell us within 14 days of the engagement starting and we refund what you have paid in full. No conditions attached and no explanation required.

After 14 days, completed milestones are not refundable, but you keep everything delivered up to that point and we hand it over properly rather than withholding it.

What we need from you

Engagements stall on access and approvals far more often than on anything technical. We need:

  • a single person who can approve work and make decisions
  • access to the accounts we are working in — ad platforms, analytics, CMS, hosting, repository
  • feedback consolidated into one response per round rather than arriving piecemeal
  • anything you have promised to supply, such as content, photography or brand assets

Where a delay on your side pushes a timeline, we will reschedule rather than cut quality, and we will say so at the time.

Who owns the work

You do, once you have paid for it. Files, source code, accounts and documentation transfer to you at handover, and we record a walkthrough so your team can carry on without us.

We keep ownership of our own pre-existing tools, libraries and internal methods, and you get a perpetual licence to use them inside the thing we built for you.

Third-party items we buy on your behalf — fonts, stock photography, plugins, platform subscriptions — stay under their own licences, and we tell you which those are.

We may describe the work publicly and show it in our portfolio, including the results it produced. If you would rather we did not, say so and we will not.

Confidentiality

Anything you share that is not public stays between us, and that holds after the engagement ends. The same applies in reverse to our pricing, proposals and methods.

What we do not guarantee

This is the clause worth reading twice.

The campaign results shown on this site happened in real accounts we managed, and every figure is reported rather than modelled. They are not predictions. Your market, offer, budget, pricing, sales process and competition all differ, and we will not promise you a specific return, ranking, conversion rate or revenue figure.

We also do not control the platforms we work in. Google, Meta, Microsoft, Shopify and the rest change their policies, algorithms, pricing and approval decisions without notice, and an account can be restricted for reasons outside our hands. We will tell you what happened and what we are doing about it, but we cannot be liable for the platform's decision.

What we do commit to is the scope, the timeline and the method we agreed, and to reporting honestly what moved and what did not.

Liability

Neither of us is liable to the other for indirect or consequential loss, lost profits, lost revenue or lost data.

Our total liability under an engagement is capped at the fees you paid us for it in the month the claim arose.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Ending an engagement

Retainers can be ended by either side with 30 days' written notice. Project work can be ended by either side in writing, and you pay for the milestones completed and for work in progress up to that point.

Either of us may end an engagement immediately if the other materially breaches these terms and does not fix it within 14 days of being told.

On termination we hand over what you have paid for, transfer account access back to you, and do not hold work hostage.

Changes to these terms

These terms were last revised on 12 October 2026. We may update them, and the version in force for your engagement is the one published when it started.
